1. Introductory provisions
1.1 These General Terms and Conditions (the “Terms”) govern the rights and obligations of the seller and the buyer when goods are purchased through the online store at colombe-active.com (the “Store”).
1.2 The seller is:
Colombe
sole trader (natural person – entrepreneur)
address: Galéria Cubicon, Staré Grunty 24, 841 04 Bratislava – Karlova Ves, Slovakia
Business ID (IČO): 50239112
Tax ID (DIČ): 1122048510
VAT ID (IČ DPH): SK1122048510
not a VAT payer
registered in the Trade Register of the District Office Bratislava, Trade Register No. 110-246704
phone: +421 907 123 109
e-mail: info@colombe-active.com
web: colombe-active.com
(the “Seller”).
1.3 The supervisory authority is the Slovak Trade Inspection (Slovenská obchodná inšpekcia), Inspectorate for the Bratislava Region, Bajkalská 21/A, P. O. BOX 5, 820 07 Bratislava, Slovakia, www.soi.sk.
1.4 The buyer is a consumer or a business that concludes a purchase contract with the Seller through the Store (the “Buyer”). A consumer is a natural person who, when concluding and performing the contract, is not acting within the scope of their business, employment or profession (the “Consumer”).
1.5 Provisions of these Terms that set out consumer rights apply only to a Buyer who is a Consumer. Where the Buyer is not a Consumer, the relationship is governed by the Slovak Commercial Code and the right to withdraw without giving a reason does not apply.
1.6 Matters not covered by these Terms are governed by the laws of the Slovak Republic, in particular the Civil Code (Act No. 40/1964 Coll.), Act No. 108/2024 Coll. on Consumer Protection, Act No. 22/2004 Coll. on Electronic Commerce and Act No. 391/2015 Coll. on Alternative Dispute Resolution of Consumer Disputes. This choice of Slovak law does not deprive a Consumer habitually resident in another country of the protection afforded by the provisions of the law of that country that cannot be derogated from by agreement.
2. Orders and conclusion of the contract
2.1 The presentation of goods in the Store is an invitation to submit an offer, not a binding offer by the Seller. Product photos are illustrative; colours may vary slightly depending on the display settings.
2.2 The Buyer selects the goods and size, adds them to the cart, enters contact and delivery details at checkout and chooses the delivery and payment method. Before placing the order, the Buyer sees a summary with the total price of the goods, the delivery price and any other charges, and can check and correct the details.
2.3 The Buyer places the order with a button that clearly indicates an obligation to pay (“Pay now” in the English checkout). By placing the order the Buyer confirms having read these Terms and the information on the right of withdrawal.
2.4 After receiving the order, the Seller sends an order confirmation to the Buyer’s e-mail address. The purchase contract is concluded when this confirmation is delivered to the Buyer.
2.5 The Store checkout is currently in English; these Terms, the information on the right of withdrawal and other consumer information are available in Slovak and English, and we communicate with consumers in Slovak. The Seller stores the concluded contract electronically; it is not publicly accessible, but the Seller makes it available to the Buyer on request. The Seller sends the Buyer the confirmation of the contract by e-mail (on a durable medium) no later than at delivery of the goods. It contains the Seller’s details including telephone number and e-mail address, the order summary with the total price, the information on the right of withdrawal, the model withdrawal form, the harmonised notice on the legal guarantee of conformity, information on making a complaint and on alternative dispute resolution, and the text of these Terms valid at the time of the order.
2.6 If the Seller cannot deliver the ordered goods (e.g. because they have sold out in the meantime), the Seller informs the Buyer without delay and refunds all payments received within 14 days at the latest.
2.7 The Buyer may cancel an order free of charge by e-mail until it has been dispatched. This does not affect the right of withdrawal under Article 6.
3. Prices
3.1 Prices are in euros and are final. The Seller is not a VAT payer. The delivery price is added according to the chosen delivery method (Article 5) and is shown at checkout before the order is placed.
3.2 The price valid at the time the order is placed applies to the contract.
3.3 In every announcement of a price reduction the Seller states the prior price, which is the lowest price at which the Seller sold the goods in the 30 days before the reduction or, if the goods have been on sale for less than 30 days, since they were first offered; in the case of progressive reductions the Seller may state the prior price applicable before the first reduction. Any reduction (e.g. in percent) is always calculated from the prior price.
3.4 If a price shown is obviously wrong (e.g. due to a technical error, where the price clearly does not correspond to the usual price of the goods), the Seller will notify the Buyer without delay before dispatch. The Buyer decides whether to buy the goods at the correct price – which requires the Buyer’s express consent – or to cancel the contract, in which case the Seller refunds all payments received without delay and within 14 days at the latest. The Seller will not increase the price without the Buyer’s express consent.
4. Payment terms
4.1 The Buyer can pay using the payment methods offered at checkout; the available payment methods are always shown at checkout before the Buyer places the order.
4.2 Payments are processed through the secure payment gateway of the payment provider. The Buyer enters card details directly with the payment provider; the Seller has no access to them.
4.3 The Seller does not charge any fee for the use of a means of payment.
4.4 The purchase price is payable when the order is placed. The Buyer receives proof of purchase by e-mail.
5. Delivery
5.1 The Seller delivers goods to the address given by the Buyer in the order, within Slovakia and to the countries listed on the Shipping & delivery page.
5.2 Delivery methods and prices are listed on the Shipping & delivery page and are always shown at checkout before the order is placed.
5.3 Within Slovakia, goods are usually delivered within 2–4 working days of the conclusion of the contract; delivery abroad depends on the destination. The Seller delivers the goods no later than 30 days after the conclusion of the contract unless agreed otherwise with the Buyer.
5.4 The Seller recommends that the Buyer check that the packaging is intact on delivery. If it is visibly damaged, the Buyer may refuse the parcel or have the damage recorded by the carrier. This does not affect the Buyer’s rights in respect of defective goods.
5.5 Ownership of the goods and the risk of accidental destruction, deterioration or loss pass to the Buyer on delivery, i.e. when the Buyer or a person designated by the Buyer (other than the carrier) takes possession of the goods.
5.6 If the Buyer fails to take delivery of the parcel, the Seller will contact the Buyer to agree on the next steps. If no redelivery is agreed, the Seller may withdraw from the contract and will refund all payments received within 14 days. The Seller may claim the demonstrable costs of the failed delivery and of the parcel’s return separately; it will not deduct them from the refund without the Buyer’s consent. If the Consumer gives notice of withdrawal under Article 6, Article 6 applies.
6. Withdrawal from the contract without giving a reason
6.1 The Consumer has the right to withdraw from the purchase contract without giving any reason within 14 days of receiving the goods. The goods are received on the day the Consumer, or a third party designated by the Consumer other than the carrier, takes possession of them; if an order is delivered in several parts, the period runs from receipt of the last part. The Consumer may also withdraw before receiving the goods.
6.2 To exercise the right of withdrawal, the Consumer must inform the Seller of the decision by an unequivocal statement sent before the withdrawal period expires:
a) online, using the withdrawal function “Withdraw from contract here”, which is continuously available throughout the withdrawal period at https://colombe-active.com/pages/withdrawal and in the footer of every page of the Store,
b) by e-mail to info@colombe-active.com, or
c) by letter to the Seller’s address: Colombe, Galéria Cubicon, Staré Grunty 24, 841 04 Bratislava, Slovakia.
The Consumer may use the model withdrawal form in Annex 1 to these Terms (also as a PDF), but it is not obligatory. The deadline is met if the Consumer sends the notice of withdrawal no later than on the last day of the withdrawal period.
6.3 If the Consumer withdraws using the “Withdraw from contract here” function (point 6.2(a)), the Seller will send the Consumer, without undue delay, an acknowledgement of receipt of the notice of withdrawal on a durable medium (by e-mail), including its content and the date and time of its submission. The Seller will also acknowledge, without undue delay, receipt of a notice of withdrawal sent by other means – by e-mail if the Consumer has provided an e-mail address, otherwise by letter.
6.4 The Consumer must send the goods back no later than 14 days after withdrawing from the contract, to: Colombe, Galéria Cubicon, Staré Grunty 24, 841 04 Bratislava, Slovakia. The deadline is met if the Consumer sends the goods back no later than on the last day of the period. The Seller does not accept cash-on-delivery parcels.
6.5 The Consumer bears the direct cost of returning the goods.
6.6 The Seller refunds all payments received from the Consumer under the contract, including the cost of delivery, without undue delay and no later than 14 days after receiving the notice of withdrawal. If the Consumer expressly chose a delivery method other than the least expensive standard delivery offered by the Seller for the destination, the Seller refunds delivery costs only up to the price of that least expensive standard delivery. If the Consumer withdraws from only part of the contract, the Seller refunds the price of the returned goods, and delivery costs only to the extent that delivering the goods kept would have cost less; the Seller does not charge the Consumer any additional delivery costs in connection with a partial withdrawal.
6.7 The Seller makes the refund using the same means of payment the Consumer used, unless the Consumer expressly agrees otherwise; the Consumer incurs no fees as a result. The Seller may withhold the refund until the goods have been received back or the Consumer has supplied evidence of having sent them back, whichever is earlier.
6.8 The Consumer may try the goods on just as they would in a shop. The Consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning – for example if the goods have been worn (not just tried on), washed or damaged, or carry traces of make-up, perfume or other odours. The Seller claims compensation for diminished value separately and will not set it off against the payments it must refund without the Consumer’s consent.
6.9 The Consumer may not withdraw from a contract for a) the supply of goods made to the Consumer’s specifications or made to measure, b) the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery. Clothing from the Store’s regular range (hoodies, leggings, sets, tank tops, T-shirts) is not covered by point b) and may be returned.
7. Liability for defects (complaints)
7.1 The Seller is liable for any defect that the goods have at the time of delivery and that becomes apparent within two years of delivery. A defect that becomes apparent within this period is presumed to have existed at delivery, unless the contrary is proven or this presumption is incompatible with the nature of the goods or of the defect.
7.2 After a defect is first remedied by repair, the liability period is extended by 12 months; it is extended only once, regardless of the number of repairs.
7.3 The Buyer may exercise rights arising from a defect if the Buyer notifies the defect within two months of discovering it, and no later than by the end of the period under points 7.1 and 7.2.
7.4 The goods conform to the contract if they meet the agreed and general requirements, including the durability normal for goods of the same type. Changes to the goods arising after delivery from improper use, failure to follow the care instructions on the label (washing, drying, ironing) or mechanical damage are not defects, nor is wear consistent with ordinary use and the normal durability of the goods. The Seller is not liable for a characteristic of the goods that does not meet the general requirements only if the Seller expressly informed the Buyer of it when the contract was concluded and the Buyer expressly and separately accepted it.
7.5 The Buyer may notify a defect (make a complaint) online using the complaint form, by e-mail to info@colombe-active.com or by letter to the Seller’s address; the Buyer may also use the complaint form in Annex 2 to these Terms, but it is not obligatory. Please state the order number, describe the defect and the remedy requested, and attach photos. For repair or replacement, the Buyer sends the goods to: Colombe, Galéria Cubicon, Staré Grunty 24, 841 04 Bratislava, Slovakia. The Seller bears the cost of taking over the goods for repair or replacement and reimburses the Buyer’s documented shipping cost without undue delay, at the latest when the complaint is settled. The Seller delivers the repaired or replacement goods to the Buyer at its own expense.
7.6 Without delay after the defect is notified, the Seller issues the Buyer a written confirmation of the notification of the defect (by e-mail) stating the period within which the Seller will remedy the defect. This period may not exceed 30 days from the notification, unless a longer period is justified by an objective reason beyond the Seller’s control.
7.7 The Buyer may choose between repair and replacement, but may not choose a remedy that is impossible or would impose disproportionate costs on the Seller compared with the other remedy. Before remedying the defect, the Seller informs the Buyer of the right to choose between repair and replacement and of the extension of the liability period after repair (point 7.2). The Seller repairs or replaces the goods free of charge, at its own expense and without significant inconvenience to the Buyer, within a reasonable period and no later than 30 days from the notification, unless a longer period is justified by an objective reason beyond the Seller’s control. If the Seller does not repair or replace the goods within this period, the Buyer has the rights under point 7.8. The Seller confirms to the Buyer in writing (by e-mail) how the complaint was settled.
7.8 The Buyer is entitled to a proportionate price reduction or may terminate the contract, without granting an additional period, if a) the Seller has not repaired or replaced the goods, in particular within the period under point 7.7, b) the Seller has not repaired or replaced the goods in accordance with Section 623(7) and (9) of the Slovak Civil Code, c) the Seller has refused to remedy the defect because repair and replacement are impossible or disproportionately costly, d) the same defect persists despite repair or replacement, e) the defect is so serious that it justifies an immediate price reduction or termination, or f) the Seller has declared, or it is clear from the circumstances, that the defect will not be remedied within a reasonable period or without significant inconvenience to the Buyer. The reduction must be proportionate to the difference between the value of the goods with and without the defect. The Buyer may not terminate the contract if the defect is negligible or if the Buyer contributed to it; the burden of proof lies with the Seller. Where several items were bought, the Buyer may terminate only in respect of the defective item, and in respect of the others only if the Buyer cannot reasonably be expected to keep them. After termination, the Buyer returns the goods at the Seller’s expense and the Seller refunds the price within 14 days of receiving the goods back or of the Buyer proving that they were sent, whichever is earlier, using the same means of payment unless the Buyer expressly agrees otherwise; the Seller bears all costs of the refund. The Seller is not entitled to compensation for normal wear and tear or to payment for normal use of the goods before termination.
7.9 If the Seller rejects liability for the defect, it informs the Buyer of the reasons in writing (by e-mail). If the Buyer proves the Seller’s liability by an expert opinion or a professional opinion issued by an accredited person, the Buyer may notify the defect again and the Seller may no longer reject liability; the period under point 7.3 does not apply to the repeated notification. The Seller reimburses the cost of the expert or professional opinion under point 7.10.
7.10 The Buyer is entitled to reimbursement of costs reasonably incurred in connection with notifying a defect for which the Seller is liable and exercising the related rights, in particular shipping costs (if not already reimbursed under point 7.5) and the cost of an expert or professional opinion under point 7.9. The Buyer must claim them from the Seller within two months of delivery of the repaired or replacement goods, payment of the price reduction or refund of the price, otherwise the right lapses.
7.11 A Buyer who is not a Consumer is subject to the provisions of the Slovak Commercial Code on liability for defects.
7.12 A summary of the rights under the Seller’s legal liability for defects (legal guarantee of conformity) is also given in the EU harmonised notice published on the Returns & complaints page and at europa.eu/youreurope/guarantees.
8. Dispute resolution
8.1 If the Buyer is not satisfied with how the Seller handled a complaint, or believes the Seller has violated their rights, the Buyer can ask the Seller for redress by e-mail to info@colombe-active.com.
8.2 If the Seller rejects the request for redress or does not reply within 30 days of it being sent, the Consumer has the right to submit an application for alternative dispute resolution (ADR) to an ADR body under Act No. 391/2015 Coll. The competent body is the Slovak Trade Inspection (Slovenská obchodná inšpekcia), Central Inspectorate, Department for International Relations and Alternative Consumer Dispute Resolution, Bajkalská 21/A, P. O. BOX 29, 827 99 Bratislava 27, Slovakia, e-mail ars@soi.sk or adr@soi.sk, www.soi.sk/alternativne-riesenie-spotrebitelskych-sporov. The Consumer may also approach another authorised entity on the list of ADR bodies kept by the Ministry of Economy of the Slovak Republic. Where several bodies are competent, the Consumer chooses. If the Seller rejects the request for redress, it informs the Consumer of the competent ADR bodies on a durable medium (by e-mail).
8.3 We recommend submitting the application within one year of the day the Seller’s rejection was delivered or the 30-day period for a reply expired without response; an ADR body may reject an application submitted later. The application may be submitted on paper or electronically, including on the form published on the websites of the Ministry and of the ADR bodies.
8.4 Alternative dispute resolution before the Slovak Trade Inspection is free of charge. Another ADR body may charge the Consumer a fee of up to €5 including VAT.
8.5 A Consumer habitually resident in another EU member state may also seek assistance from the European Consumer Centre in their country. This does not affect the Buyer’s right to bring the matter before a court.
9. Personal data
9.1 The Seller processes the Buyer’s personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 18/2018 Coll. on Personal Data Protection, primarily to conclude and perform the purchase contract. Details are set out in the Privacy Policy.
10. Reviews
10.1 The Seller does not publish customer reviews in the Store.
11. Final provisions
11.1 The Seller may amend these Terms. The contract is governed by the version valid at the time the order was placed.
11.2 These Terms are drawn up in Slovak and English. In the event of any discrepancy, the Slovak version prevails.
11.3 If any provision of these Terms is invalid or ineffective, the remaining provisions remain in force.
11.4 The annexes to these Terms are: Annex 1 – Model withdrawal form; Annex 2 – Complaint form (optional); Annex 3 – Information on the exercise of the right of withdrawal.
11.5 These Terms take effect on 14 October 2026.
11.6 Previous versions of these Terms are available to the Buyer on request at info@colombe-active.com.

Annex 3 – Information on the exercise of the right of withdrawal
1. Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you ordered multiple goods in one order and they are delivered separately, it will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Colombe, Galéria Cubicon, Staré Grunty 24, 841 04 Bratislava, Slovakia, phone +421 907 123 109, e-mail info@colombe-active.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form we have given or sent you, but it is not obligatory.
You can also exercise your right of withdrawal online at https://colombe-active.com/pages/withdrawal (the “Withdraw from contract here” link in the footer of every page). If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail), including its content and the date and time of its submission, without undue delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
2. Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us at Colombe, Galéria Cubicon, Staré Grunty 24, 841 04 Bratislava, Slovakia, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
